    If they decide to cut-off some day next week can't believe how a day or two would make a huge difference in someone's lives. This is very cruel. We have to react based on the infomration we have and it keeps changing every day. So every time I have to run to my manager/director ask them to escalate to HR and they talk to Lawyer. I look like a guy pushing panic button all the time but in reality if we don't act quickly will regret for next few years. Never had a such a bad July4th holiday :(

    I got the same approval notice. But online status showing as Card Production Ordered. What does it say for you? Do you see any difference in the status between you and your wife?

    I received I-485 approval letter from USCIS today which reads as follows:

    "The above application has been approved. Prior to receiving your permanent resident card you may be required to report for biometrics processing (photo/fingerprint/signature). Please do not take any action at this time. If you are required to report for this processing, you will receive another notice advising you of the date, time and location to appear.

    If you have not received your permanent resident card or the above mentioned notice to appear for biometrics processing within 90 days, please call this office at the number listed above."

    Did anyone receive a notice like this? How many days did it take to get the biometric notice after this notice if anyone received the above?

    My wife already received her physical green card although she is beneficary of my application.

    I was planning on going to India in Nov, but can't book now as I don't know how long it will take :mad:

    I don't think InfoPass will entertain me to request for Biometrics especially since this notice tells to wait.

    Anyone with similar notice, any inputs are greatly appreciated. Thank you friends!!

    - H1 is still valid even if your 485 got rejected until you get notice to that regard separately.
    - If you have not shifted to EAD,You can continue working on H1

    I continued working on H1 during my MTR approval process( Sep08 to Dec 08). My 485 got rejected due to earlier employers revocation of I 140.

    Attorney gets the notice. Find out from all your attorneys and their staff if you have access to do so.

    Call USCIS and find out the reason of rejection first or take info pass and find out the reason and act fast. You have already crossed general response time(30 days normally).

    I am a silent visitor of this website.
    Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
    Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??

    Please try to understand their problem.
    Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

    My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

    Isn't it a shame on us to go for Rally to get GC?????:D

    Just think that you will get it when time comes, otherwise pack up.

    Please don't take much tension as life is very short. I am assuring you all, nothing will happen with law suit and flower campaign.Don't irritate USCIS by doing all this please.

    Biometrics has no questions to answer. Just follow their instructions at the center.

    To create SR,

    Call the toll free number and select some options for you to reach a live representative.

    Tell them that you are waiting for a very long time and needs update.

    You need to have your receipt notice with you. And your wife too (matters only if you are married, just for the sake of it, do not bring in anyone else's wife...just kidding)

    If your wife is not with you, they will create the SR for her. Hence suggested. Take down the name of Rep and the confirmation number.

    That's it.

    please ignore the dots...the important thing is to make the lawmakers aware of the issue. As mirage mentions we should send a letter to the rep Logfren, (i have mailed the letters), we just want them to be aware that there is an issue, ROWs please send them too, you will also be impacted. Nothing against EB2's or the comments they have passed so far, we dont want to undermine your visas, the idea here is simply to make the lawmakers and DOS/USCIS aware of the problem.

    In a way DOS/USCIS have opened a pandoras box because EB3 as a whole will see slower approvals leading to a larger number of countries stuck in the process across a spectrum of countries. earlier it was mainly india, china and mexico. If visa allotment policy holds then you will see more countries getting retrogessed.


    Some one gave me this comment saying



    Show me where have I undermined IV efforts? And show me nonsensical or counterproductive posts that I have made -- that is, nonsensical or counterproductive to the cause of upholding the law (not pandering to a particular employment category/chargeability area).

    I have done my homework, and I have understood the law properly. I have time and again given logical proof, along with the text of the law, as to why EB3 is eligible get the EB1 numbers at the same time as EB2. On the other hand none of the detractors have provided proof, or material that shows EB3 does not qualify.


    And for all those holier-than-thou EB2, what is about the letter campaign to get NSC/TSC to process application according to PDs (no lawful basis for that), and asking the removal of NSC bosses and what not. You seem to have different standards when you are suffering, and when others are suffering. There is a word in the dictionary for that, look it up.

    Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.

    Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.

    INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.

    It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?




    if a change in interpretation is done intentionally, then USCIS admits they were allotting visas incorrectly during the previous years...if it were a public company, lawyers would be climbing over one another to file a class action suit...unfortunately all we can do is write letters, make phone calls and pray :rolleyes:

    Isn't it part of her job? There is nothing like being servant. Moreover, it was just asked to rinse the bottle with hot water, to be sure it is hygenic, in a circumstances when baby was making tantrums. Another reason for asking was because bathrooms were full, otherwise there wouldn't have been a need. We have travelled many other airlines, and there was never an issue for such requests. Many airlines go extra mile to please you. It is what is called customer service.

    I don't understand why is it hard or degrading? Maybe then they are not supposed to serve you a cool cup of water at your seat as well. Is that demeaning as well on part of her job?

    no its not part of her job. I know a stewardess, and this exactly the part she dislikes about her job. people think its her job to attend to all little demands of the passengers.
    She has two duties on the plane, in order:
    - safety of the passengers. this is #1.(ensuring luggage is stowed, seatbeats are on, people are not wandering around the aisles; co-ordinate and help in case of emergencies)
    - basic service (serve food, clear the trays, handle simple requests like juice/water, ice barfbags etc). This does not include cleaning out your babies bottles. Some airlines have stewardesses who would go out of their way (I have seen Singapore Airlines do this) but again, rinsing a baby's bottle is NOT part of her job. She can get you a bottle of hot water if you want and you can rinse it yourself either in the sink or into the barf-bag.

    Good job in creating the thread. Around the time when you started this or little before I too created one more asking Citizenship (I'm sure many more might have, too), but I would like to push your thread just to not divert attention to too many spots.

    We will make next week as a "WEEK OF ACTION". If you see my other thread ("can we send Pizza" thread) and many others, the common routine is to get many good ideas, but not much action.

    We will gather as much support as we can till this weekend and at the same time make sure we consolidate the contact information at one place who to contact, and then starting next week, we can start sending out our message as loud as we can.
    We must push for 5 years GC and 10 years Citizenship. I know how much painful it canbe for someone after 11 years waiting for GC, wheras others with 6-7 years in US applying for Citizenship. Not that they got it, but why we did not get it.
    And we will focus on points how we can contribute in this crisis.

    No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.

    If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.

    If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

    You are correct. When I filed on 2005 I did not apply for either AP or EAD. My H1 was valid until May 2007 and I do not intend to change jobs or travel(my country is too dangerous :mad: ).
    I am already 55 :rolleyes: and am not going anywhere.
    In January 2007 I filed EAD myself and got it approved in 40 days. My lawyer was charging me $400 to file it.

    How do you know when the process begins and how do you find out if your name clears or is stuck like so many others?

    Call (in the morning) 1-800-375-5283 and follow this sequence: 1,2,2,6,1,1,1,3,4.

    If the Immigration Officer is kind enough you can ask if the Name Check is cleared. If he/she says No, you can ask him/her the date it was sent to the FBI.

    Hi All, I had a quick question.
    My I-485 got approved earlier this week from NSC and I received the approval/welcome letter by USPS.
    My online status is at post-decision activity and not at CPO.
    Though my welcome notice says that I should receive the card in 3 weeks, I am wondering if I need to be at CPO status before that happens....also I read somewhere they may require another FP before CPO (that was talking more abt transfer cases, but mine has always been at NSC).....but nowhere in my approval notice does it ask for an FP.
    I was wondering if I should just sit tight and wait for the physical card or try to find out more information.

    USCIS will be liable to pay the expenditure incurred by each applicant (laywers fee, medical exam fee, cancelled air tickets etc) and not to mention the mental stress caused by this whole episode of renegging on their visa bulletin.

    They should have done in the last week of June instead of waiting for july 2nd monday.
    Technically all those applications that will be in the mail before the fresh visa bulletin on monday or tuesday has to be honoured by USCIS come what may.

    If not, they will have to face lots of legal cases not to mention the embarassment of incompetency of these USCIS employees.

    Let us pool together money for a legal case.

    Dont worry boehner and obama will pass a short term budget once again......its all political posturing most of the time

    Unfortunately the Timing of IV Advocacy day, and also May 2011 VB schedule at a wrong date. If the Govt Shutdown due to the budget deadlock, I'm not sure how both of these days will play out. Any Idea guys. :confused:
